TERMS AND CONDITIONS

These terms and conditions belong to MONOIC LLC, who for the purpose of these Terms and conditions is referred as "MONOIC STUDIOS", in turn, the website along with its functionality and the intangibles that compose it will be referred to as the “Portal”.

We appreciate reading these terms and conditions carefully, considering that their acceptance is mandatory for the use of this Portal and browsing and/or using it implies that you have read and accept these terms and conditions. If you do not agree to these terms and conditions, you must abstain from using this Portal.

MONOIC STUDIOS may modify the Terms and conditions at any time, once modified this terms will become effective 10 days after they are posted. The continued use of the Portal will be understood as acceptance of such modifications. For this reason, these Terms and Conditions are intended to regulate the contractual relationship between the User and MONOIC STUDIOS, regarding the subscription to the page and the sale of products offered by MONOIC STUDIOS.

In addition to knowing and accepting these Terms and Conditions, the User must have read and accepted the Privacy Policy and personal data processing. By acquiring products from MONOIC STUDIOS, the User accepts and is aware that they are associated by these Terms and Conditions and by the Privacy Policy and personal data processing.   

DEFINITIONS:

COOKIES: Virtual text strings sent and stored by the Operator through the use of the Portal, for the consultation of user activities and preferences.

E-COMMERCE: It includes sending, transmitting, receiving, and storing data messages electronically. 

INTERACTION ON THE PORTAL: User's access capability to know and acquire products on the Portal, accessing the various available references.

OPERATOR OF THE PORTAL: Responsible for administrating operationally and functionally the portal, represented for the purposes of these terms by petitions, complaints, and claims MONOIC STUDIOS, or by the natural or legal person designated by it.

PORTAL: Website that allows and facilitates offering different products.

ADVERTISING: It is any form of communication made by the allied commerce through the Portal, in order to provide information about products, commercial activities, and communicate strategies or advertising or marketing campaigns, owned or third parties; carried out as a reference mechanism and not as a public offer.

SERVICES: Acquisition of any product offered on the portal.

CLIENT: Natural or legal person who accesses, navigates, or performs any type of activity through the Portal. Refers to consumers, potential consumers, and beneficiaries of any product offered by the Portal.

CONTENT

These Terms and Conditions apply without restriction or reservation to all functionalities and/or services provided through this Portal.

MONOIC STUDIOS at all times has the right to manage the Portal for the development of new references or functionalities, even eliminate them, without the User being able to claim any compensation.

In the use of the Portal, Users may disclose information from third parties, so they accept that they have authorization to disclose it.
The User understands and accepts that MONOIC STUDIOS may include advertising and that it is necessary for it to provide the service. Likewise, understands that all images and photos used on the portal belong to it, are public domain, or are used with the necessary authorizations. For this reason, they have the respective permission for use.
MONOIC STUDIOS has the power to send ADVERTISING communications and messages of any kind that are necessary for the proper provision of the customer service. Any new functionality that modifies, increases, or improves the current service of the PORTAL, including the launch of new references, will be subject to these Terms and conditions.
PRODUCT PRICES
The prices of the products found on the PORTAL do not include the additional costs of their respective shipments and international duties. Thus, these must be assumed by the customer at the end of the purchase process. All prices are subject to change without prior notice.

PRODUCT AVAILABILITY

MONOIC STUDIOS informs that this Portal is updated daily with the inventory available. For references that are available, a delivery time of up to five (5) business days is typically managed.
MONOIC STUDIOS will not intentionally sell more references than its production capacity allows.
MONOIC STUDIOS undertakes to provide its customers with timely and truthful information about the status of their order. If the specific reference of the unit or units requested by the customer is not available, MONOIC STUDIOS undertakes to coordinate the production of these or to refund the money that the customer has disbursed for the purchase.

PRODUCT PAYMENT
MONOIC STUDIOS will charge CUSTOMERS for the products offered on its Portal. The rates are subject to modification without prior notice to the USER, and this will be updated and published on the Portal. The prices assigned on our international website do not include the cost of shipping and taxes. Prices are in US dollars.

A secure payment system provided by Shopify Payments has been established by MONOIC STUDIOS for any order placed on the portal. The payment will be considered complete once the system has confirmed it. If the bank does not accept the payment, the order will be automatically rejected, and MONOIC STUDIOS will be exempt from any obligations and liabilities towards the customer. 

The payment for the products can be made through the payment methods available at the time of purchase and the applicable prices will be charged automatically, through the checkout system of the portal.

MONOIC STUDIOS will not have access to the financial data of the CUSTOMER to carry out the transaction, the corresponding financial entities being responsible for the processing of this data.
Promotions and discounts, as well as their conditions, will be available on the Portal only when MONOIC STUDIOS informs directly. It reserves the right to restrict the use and recover the amount of promotions, invitations, and discounts to Users who make improper, unlawful, or abusive use of them or the Portal.

MONOIC STUDIOS will add the additional cost of shipping to each final price reflected on the PORTAL before making the payment. This cost will be authorized by the customer before paying for their order. For international orders, MONOIC STUDIOS, is not responsible for the payment of duties charged on delivery. If this applies, taxes and duties have to be paid by the customer at the arrival of the product.

SHIPPING, DEADLINES, PLACE OF DELIVERY, AND PRODUCT LOSSES

MONOIC STUDIOS is committed on delivering the order of each customer in optimal conditions to the address provided on the PORTAL www.monoicstudios.com or through its Instagram account @monoic_studios. MONOIC STUDIOS will not be responsible for mistakes in delivery details provided by CUSTOMERS.

Shipping: 

For all other purchases, shipping costs will be calculated at the last step of the checkout and will be calculated based on the country and weight of the package. 

Our shipments are made through FedEx or DHL and delivery times depends on the package destination. Orders will be shipped once they are approved by the bank or by the payment system. Automatically, customers will receive tracking information via email. 

IMPORTANT: If you do not receive this, we recommend you to check your spam folder.

Delivery time: 

MONOIC STUDIOS will dispatch orders through its logistics partners. Once the payment of the order has been confirmed, the CUSTOMER will receive a confirmation email of their purchase with the respective delivery details. 

Likewise, as soon as the product is delivered to the logistics partner, the CUSTOMER will receive a copy of the shipping label. 

Delivery conditions will be based on the preferences selected by the user and the available delivery options within MONOIC portal. 

Estimated delivery times: From 2 to 5 business days. 

MONOIC STUDIOS is not responsible for delays that the logistics partner may have in its operation. MONOIC STUDIOS will also not be responsible in cases where, due to the CUSTOMER, the order could not be delivered. In those cases, the customer must contact the company described in the guide to reschedule the delivery.

In the case of theft or loss of the package, the responsibility lies directly with the logistics partner, who must locate it or respond for its insured monetary value.

If the product has not been successfully delivered within the next five (5) business days, the customer must contact the customer service email: contacto@monoicstudios.com. If the customer does not proceed accordingly, after five (5) business days of the product's shipment, the shipment must be returned and associated the expenses must be assumed by the customer.

Delivery diligence 

Upon arrival of each product at its destination, the customer must verify the good condition of the order with the courier company, indicating any anomalies that may arise. If the order arrives damaged due to a situation caused in the shipment, the CUSTOMER must report it within a maximum period of seventy-two (72) hours prior receiving to MONOIC STUDIOS. If after seventy-two (72) hours the respective claim is not made, MONOIC STUDIOS will not be responsible for such damages. MONOIC STUDIOS will only be responsible for the warranty of the part or parts.

Incomplete package: 
If the product arrives incomplete at its final destination, the CUSTOMER must report within seventy-two (72) hours to MONOIC STUDIOS through the email: contacto@monoicstudios.com or its official Instagram account: @monoic_studios to start the formal process.

RETURNS POLICY

If you want to make the return of any product, please note the following information:

The return can be made via MONOIC STUDIOS customer service email contacto@monoicstudios.com. The CUSTOMER will have a period of thirty (30) calendar days from the date of purchase to make the return. Discounted products cannot be returned. Returns are made based on the value of the purchased product. If the CUSTOMER wants to change it for a more expensive product, he must pay the difference in price and the shipping. The product must be in perfect condition for the return to be made, free of odors and perfumes, with all original packaging, tags, parts, accessories, and labels attached, it must be unused. Returns cannot be made if it is noticed as used, worn, or altered.

Items purchased during our Black Friday Sale are not eligible for returns.

DISCLAIMER OF WARRANTY RESPONSIBILITY.

MONOIC STUDIOS is not responsible and is exempt from responding to the warranty of the product in the following cases:

Normal wear and tear of the product. Defects caused by accidents. (example: use of chlorine) Improper use of it. The stipulated end of the product warranty. Failure to comply with the product care instructions. (example: ironing prints). Refer to the Warranty and Returns section for more information.

PACKAGE DAMADGED
If you receive your package, and it is damaged and/or opened, please take a photo of the damage before checking the content inside.  Contact us via email or our Instagram page contacto@monoicstudios.com / @monoic_studios with your claim.


DISCOUNTS
Coupons cannot be combined with other promotions and are limited to one use per customer. When we offer our discount coupons, the value of the coupon and the dates on which it can be redeemed will be explicitly stated in it.
